Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("you" or "User") and Nourish Biome AI, located at 1201 Jupiter Park Dr Unit 5, Jupiter, FL 33458, United States ("Nourish Biome", "we", "us", or "our"). By creating an account, accessing, or using our website, applications, and related services (collectively, the "Service"), you accept and agree to be bound by these Terms and our Privacy Policy and Medical & AI Disclaimer. If you do not agree, do not use the Service.

You must be at least 18 years old to use the Service.

Nourish Biome AI is a metabolic-health optimization platform that provides:

• An AI Nutrition Coach for general nutrition and metabolic-health guidance
• Personalized meal plans and recipe recommendations
• A recipe library with blood-sugar spike and microbiome scoring
• A daily Nourish Score and progress tracking
• Educational content on GLP-1 nutrition support, gut health, and blood-sugar stability

To access certain features, you must register for an account. You agree to provide accurate, current, and complete information, maintain the security of your credentials, and accept responsibility for all activity under your account. Notify us immediately of any unauthorized use.

• Subscriptions are billed in advance on a recurring monthly basis at the then-current published rate (currently $19 USD per month).
• Payments are processed by our third-party payment processor (Stripe). By subscribing, you authorize recurring charges to your payment method until you cancel.
• You may cancel at any time. Cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law.
• We may change prices or available features with at least 30 days' notice. Continued use after a price change constitutes acceptance.

You agree to use the Service only for lawful purposes. You will not:

• Violate any applicable law, regulation, or third-party right
• Provide false or misleading health, identity, or payment information
• Attempt to gain unauthorized access to any portion of the Service
• Reverse engineer, scrape, or commercially resell the Service or its content
• Use the Service to harass, harm, or impersonate any other person
• Upload malicious code or interfere with the Service's operation

The Service does not provide medical, diagnostic, or treatment advice. All recipes, scores, plans, and AI-generated suggestions are general educational information only. You must consult a licensed physician or qualified healthcare provider before starting, stopping, or changing any diet, supplement, medication (including GLP-1 medications such as semaglutide, Ozempic®, Wegovy®, tirzepatide, Mounjaro®, or Zepbound®), or health protocol.

The Service and all content, features, and functionality — including the Nourish Score, scoring methodologies, recipes, copy, design, and software — are owned by Nourish Biome AI and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of content you submit; by submitting, you grant us a worldwide, non-exclusive, royalty-free license to use that content solely to operate and improve the Service for you.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied.

To the maximum extent permitted by law, Nourish Biome AI disclaims all warranties including merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, accuracy, and that the Service will be error-free or free from harmful components. We do not warrant any specific health, weight, glucose, or wellness outcome.

To the maximum extent permitted by law, Nourish Biome AI shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or related to your use of — or inability to use — the Service.

Our aggregate liability for any claim arising out of or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

You agree to defend, indemnify, and hold harmless Nourish Biome AI and its corporate affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

We may suspend or terminate your account and access to the Service at any time, in our sole discretion, including for breach of these Terms. Upon termination, your right to use the Service ends immediately. Sections of these Terms that by their nature should survive (including IP, disclaimers, limitations of liability, indemnification, and governing law) will survive termination.

We may modify these Terms from time to time. If a change is material, we will provide at least 30 days' notice via the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
